ACCEPTANCE OF THIS AGREEMENT
Dapper Direct provides an environmentally-friendly, on-demand fashion delivery service. Catering to the young and affluent urban market, Dapper Direct provides a digital shopping experience that quickly and efficiently connects consumers with trusted apparel brands, emerging labels, and other curated fashions.
MODIFICATIONS
Dapper Direct LLC reserves the right to modify the terms of service of this Agreement or its policies relating to services at any time, effective upon posting of an updated version of these terms of service through the site. You should regularly review these terms of service, as your continued use of the services after any such changes constitute your agreement to such changes.
TERMS OF
USER REGISTRATION
3.1 You agree to go through the registration procedure by filling out the registration form (on the Site under the heading “Log in to your account”, in the application – “Login”).
3.2 Acceptance of these terms of service is allowed only in full, acceptance of the terms of service with exemptions and/or in part is allowed only in cases expressly providing for it.
3.3 You are responsible for the security and restriction of access to your mobile device/computer and Dapper Direct account. All actions performed within the framework of using the service using your account are considered to have been committed by you.
3.4 You agree that you are obliged to immediately notify Dapper Direct of any case of unauthorized (unauthorized) access under your account and/or any breach of security.
3.5 You have the right to have only one profile in the Dapper Direct service system (“prohibition of creating multiple profiles”). The creation of several profiles to obtain benefits by misleading is a violation of these rules and may lead to the immediate blocking of all your profiles, as well as to the impossibility of using all specified/used phone numbers/email addresses/bank cards of in the Dapper Direct service system in the future.
CHECK-OUT
4.1 The order can be placed by the user using the functionality of the Dapper Direct service.
4.2 To place an order on the service, you must take the following actions:
a) Fill out the information about the delivery address. If you provide incorrect/incorrect information or Dapper Direct has serious grounds to believe that the information provided by you is incorrect, incomplete, or inaccurate, Dapper Direct has the right to suspend or cancel your registration and refuse to use the service;
b) Pay for the order.
4.3 Photos of apparel and/or clothing posted on the service are for reference only; the actual apparel and/or clothing may not correspond to such photos.
4.4 Notifications about delivery times provided to you are for informational purposes only and may not take into account circumstances beyond the control of Dapper Direct, including delays due to unfavorable weather conditions, traffic congestion, etc. Also, you confirm your consent that during the period of increased demand, the time for order confirmation and delivery may be increased.
4.5 You are responsible for the completeness, sufficiency, and correctness of the data entered when placing the order. You bear the risk of the consequences of incorrectly specifying the information necessary for the execution of the order, including those leading to the impossibility of the proper execution of the Order.
4.6 Dapper Direct reserves the right to refuse the user to use the Dapper Direct service without notifying the user and/or without explaining the reasons.
RESPONSIBILITY
5.1 The parties are responsible for non-fulfillment or improper fulfillment of their obligations in accordance with the current legislation.
5.2 Dapper Direct has the right to receive questions from users regarding the delivery of the Order within 24 (twenty four) hours from the date of delivery / expected delivery, while in order to avoid fraud, the user undertakes to provide materials with photo / video recording of damage to the order or other violations of quality / completeness with compliance with the requirements of the contact center.
5.3 Dapper Direct has the right to verify the user using the phone number specified during registration, in case of doubts or controversial situations, claims and complaints from users who have not been verified are not considered acceptable.
5.4 Dapper Direct reserves the right to cancel the user’s order, block the user’s account in cases where the user uses obscene language, is rude, is impolite, violates the requirements of this terms of service.
GOVERNING LAW
These terms of service shall be construed in accordance with the laws of the state of Georgia, without reference to its conflict of law provisions, and the obligations, rights and remedies of the parties hereunder shall be determined in accordance with such laws.
LIMITATIONS
In no event will Dapper Direct be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the services or any materials or content available through Dapper Direct, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Dapper Direct has been informed of the possibility of damage.
INDEMNIFICATION
You agree that you will be responsible for your use of the Dapper Direct service, and you agree to defend and indemnify Dapper Direct from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with:
(i) your access to, use of, or alleged use of, the website;
(ii) your violation of any portion of these Terms, any representation, warranty, or agreement referenced in these Terms, or any applicable law or regulation;
(iii) your violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or
(iv) any dispute or issue between you and any third party. Dapper Direct reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defense of that claim.
ENTIRE AGREEMENT
This Agreement contains the entire agreement and understanding among the parties hereto with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to the subject matter hereof. The express terms hereof control and supersede any course of performance and/or usage of the trade inconsistent with any of the terms hereof.
